The improved and revised 5th edition of the book entitled “General Theory of Fundamental Rights” authoted by Prof. Dr. Zafer Gören, a faculty member at Istanbul Ticaret University Faculty of Law, has been published.
The 1st edition of Prof. Dr. Gören’s book was published by Cumhuriyet Printing House in Izmir in 1993, and the 2nd, 3rd and 4th editions were published by Dokuz Eylül University publications in 1993, 1995 and 2000, respectively. Prof. Dr. Gören’s book aims to introduce the scientific debates and practices on the General Theory of Fundamental Rights to law students and to also benefit the Constitutional Court.
In the book, the emergence, historical development, definition, interpretation, types and functions of fundamental rights, fundamental right ownership and liability, the problematic of waiver and loss of fundamental rights, fundamental right guarantees and limitations to the fundamental right are examined within the scope of the “General Theory of Fundamental Rights” or “Fundamental Rights Dogmatics”, which form a part of the Constitutional Theory.
Providing information about the book, Prof. Dr. Gören has said:
“The issues related to the General Theory of Fundamental Rights have been reviewed in comparison with the German Law in the book, due to the fact that Germany has been one of the most developed countries in the fields of Constitutional Law and Constitutional Jurisdiction, that the constitutional legal developments in Germany have greatly influenced our 1962 and 1982 Constitutions and the development of our constitutional law till today, that the Constitutional Court Law of the Federal Republic of Germany was especially taken into account in the preparation of the Draft Law on the Establishment and Trial Procedures of the Constitutional Court dated 22.04.1962, and that a strong constitutional jurisdiction was established with the Constitution of the Federal Republic of Germany.”
Prof. Dr. Gören underlined that the Constitutional Court has been authorized with the introduction of the Individual Application into the Turkish Constitutional Judiciary system in 2010 not only to clarify and elucidate the constitutional and legal order, but also to protect the fundamental rights of individuals in the context of the proceedings and decisions originated from the executive and judiciary bodies, and stated that he thinks that the Constitutional Court can also benefit from this book, considering that it deals with a subject that is at the center of its decisions.
The annex of the book, which is published by Yetkin Publishing, includes the European Convention on Human Rights and additional protocols.
