2020-2021 Eğitim-Öğretim Yılı Bahar Yarıyılı Sınavları Hakkında Duyuru / Announcement on 2020-2021 Academic Year Spring Semester Exams

Yükseköğretim Kurulu Başkanlığı (YÖK) 17.02.2021 tarih ve 75850160-19911439 sayılı yazısında 2020-2021 eğitim-öğretim yılı bahar yarıyılında yapılacak tüm sınavların elektronik ortamda “gözetimli sınav” şeklinde yapılmasını ve bu sınavlara ilişkin “şeffaflık ve denetlenebilirlik” ilkesi esas alınarak gerekli takip, tedbir ve imkanların sağlanması gerektiğini bildirmiştir.
Bu çerçevede İstanbul Ticaret Üniversitesi Senatosu, 13 Nisan 2021 günü yaptığı toplantıda 2020-2021 Eğitim-Öğretim Yılı Bahar Yarıyılında yapılacak sınavların gözetimli olmasına ve sınav boyunca kameranın açık olmasına karar vermiştir. Söz konusu karar sınav esnasında kimlik tespitinin yapılabilmesi, sınava kayıtlı öğrencinin dışında farklı bir öğrencinin veya 3’üncü bir kişinin sınava girmesinin ya da sınavlarda kopya çekilmesinin engellenmesi gibi tüm öğrencilerimizi ilgilendiren gerekçelerle alınmıştır.
Dijital ortamda çevrimiçi yapılacak sınavlara, teknik alt yapısı yetersiz olduğu gerekçesiyle dijital erişim sağlayamayan ya da Kişisel Verilerin Korunması Kanunu veya mahremiyet gerekçesi ile girmek istemeyen öğrencilerimiz bu durumunu sınav tarihinden en az 7 gün önce bağlı bulunduğu Dekanlık veya Enstitü Müdürlüğüne yazılı olarak bildirmesi halinde Sütlüce yerleşkemizde sosyal mesafe ve hijyen kurallarına uygun ortamda sınavlara girebileceklerdir.
KİŞİSEL VERİLERİN KORUNMASI KANUNUNA UYGUNLUK
Sınavda kameranın açık olmasına ilişkin uygulama 24.03.2016 tarih ve 6698 sayılı Kişisel Verilerin Korunması Kanunu’na aykırılık teşkil etmemektedir. Anılan Kanun’un 5’inci maddesinin 2’nci fıkrasında, ilgili kişinin açık rızası aranmaksızın kişisel verilerin işlenebileceği durumlar belirtilmiştir.
Söz konusu düzenlemenin (ç) bendinde, veri sorumlusunun hukukî yükümlülüğünü yerine getirebilmesi için zorunlu olması; (e) bendinde, bir hakkın tesisi, kullanılması veya korunması için veri erişimi zorunlu olması durumunda, ilgili kişinin açık rızası aranmaksızın kişisel verilerinin işlenebileceği hükme bağlanmıştır. Dolayısıyla, bu uygulamada herhangi mahremiyet ihlali bulunmamaktadır. Ayrıca Üniversitemiz, sınav güvenliğinin sağlanması amacıyla toplanan kişisel verileri, Kişisel Verilerin Korunması Kanunu ve ilgili mevzuat hükümlerine aykırı olarak başkalarına açıklamayacağını ve işleme amacı dışında kullanmayacağını, herhangi bir kopya olayını belgeleyen görüntüler dışındaki tüm görüntülerin, işlenme amacının sona ermesi durumunda silinerek yok edileceğini taahhüt etmektedir.

Announcement on 2020-2021 Academic Year Spring Semester Exams
According to the letter of the Council of Higher Education (YÖK) dated 17.02.2021 and numbered 75850160-19911439, all exams to be held in the spring semester should be conducted electronically in the form of “supervised exams” and that the necessary follow-up, precautions and facilities should be provided based on the principle of “transparency and auditability” regarding these exams.
In this context, the Senate of Istanbul Commerce University, in its meeting held on April 13, 2021, decided that the exams to be held in the Spring Semester of the 2020-2021 Academic Year should be supervised and the cameras should be on during the exam. The decision was taken for reasons that concern all our students, such as being able to be identifies during the exam, preventing a different student or a third person other than the registered student from taking the exam or cheating during the exams.
Students who cannot access online exams in the digital environment due to insufficient technical infrastructure or who do not want to enter due to privacy reasons can submit a written petition to the Dean’s Office or Institute Directorate at least 7 days before the date of the exam. They will be able to take the exams in our computer laboratories suitable for distance and hygiene rules in our Sütlüce Campus.
COMPLIANCE WITH THE LAW ON THE PROTECTION OF PERSONAL DATA
- The application as to keeping one’s camera on during the exam does not constitute any contradiction to the Law on the Protection of Personal Data Law dated March 24, 2016 and numbered 6698. The conditions which enable the personal data to be processed without seeking the explicit consent of the related person are set forth in the paragraph 2 of Article 5 aforementioned. The entitlement of processing personal data without seeking the explicit consent of the related person has been adjudicated as per the (ç) Law Clause, when it is required for the data subject to be able to fulfil his / her legal obligation, and as per the (e) Law Clause, when data processing is necessary for the establishment, exercise or protection of the right. Hence, there is no breach of privacy. Furthermore, our University guarantees that it is not going to disclose the personal data collected for the purposes of ensuring exam safety to other parties and it is not going to use the personal data in question for purposes except for data processing. The contrary conditions would be against the Law on the Protection of Personal Data and the related legislation provisions. Our University also guarantees that all the images except for the ones which prove any case of cheating shall be destroyed by erasure when the purpose of data processing expires.
